Terms and Conditions for Kaha Pilates

Effective Date: 01.03.2025

Welcome to Kaha Pilates (“we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website www.kahapilates.co.uk ("the Site") and your purchase of products from us, including fitness equipment, Pilates reformers, and custom orders. By using the Site or purchasing products from us, you agree to comply with these Terms.

1. General Information

The Site is operated by Kaha Pilates, a General Partnership registered in UK. Our business offers a variety of fitness equipment, Pilates reformers, and custom-designed products. We strive to provide high-quality products and excellent customer service.

2. Product Information

We make every effort to accurately display the features, specifications, and prices of our products. However, we do not guarantee that the product descriptions, pricing, or availability are error-free or complete. We reserve the right to correct any errors or inaccuracies, including changes to product prices, without prior notice.

3. Ordering and Payment

By placing an order on the Site, you confirm that you are legally authorised to make the purchase. When you place an order, you are offering to buy the selected products, subject to these Terms.

  • Order Confirmation: Once your order is placed, you will receive an email confirmation detailing your order. This does not signify our acceptance of your order, and we reserve the right to cancel or refuse any order at our discretion.

  • Payment: Payment for orders is due at the time of purchase. We accept various payment methods, including credit/debit cards, PayPal, and other online payment systems as specified on the Site.

  • Pricing: Prices listed on the Site are in GBP and are subject to change without notice. Applicable taxes and shipping fees will be added to the final price.

4. Age Restriction

To place an order on our Site, you must be 18 years of age or older. By making a purchase, you confirm that you are at least 18 years old. If you are under 18, you may only use the Site with the involvement and consent of a parent or guardian. We reserve the right to refuse or cancel orders placed by individuals who do not meet the age requirement.

5. Custom Orders

For customers interested in custom-made fitness equipment or Pilates reformers, the following additional terms apply:

  • Custom Order Process: To place a custom order, you must provide specific design details, measurements, and preferences. This may include selecting materials, colour choices, features, and dimensions. We will work with you to finalise the design and provide an estimated cost and timeline.

  • Non-Refundable Deposits: A non-refundable deposit of 50% of the total price is required to initiate a custom order. This deposit ensures that we can begin the design and manufacturing process. The remaining balance will be due upon completion of the product or before shipment.

  • Order Confirmation and Production: Once the custom design is approved by you, we will begin the production process. Custom orders are final and cannot be altered or canceled after production begins. Any changes to the custom design requested after production begins may incur additional charges.

  • Estimated Delivery Time: Custom orders may take longer to manufacture and deliver than standard products. We will provide you with an estimated delivery time when your custom order is confirmed. Please note that delivery times are estimates and may vary based on production schedules, material availability, and other factors.

  • Quality and Specifications: While we strive to meet your exact specifications, custom orders are subject to variations in materials, finishes, and other production factors. We cannot guarantee an exact match to any samples or images provided, as natural variations in materials (such as wood or fabric) may occur.

  • Returns and Refunds for Custom Orders: Custom-made products are non-returnable and non-refundable unless there is a defect in craftsmanship or materials. If the custom product you receive is damaged, defective, or not made according to the agreed-upon specifications, we will work with you to resolve the issue, including offering a replacement or repair.

  • Warranty for Custom Orders: Custom products may come with a limited warranty, depending on the type of product. The warranty coverage will be specified in the product's warranty documentation and may vary based on the materials and workmanship involved.

6. Shipping and Delivery

  • Shipping: We offer shipping within the UK. Delivery times vary depending on your location and the shipping method selected. We strive to process orders promptly, but delivery times are estimates and may be subject to delays beyond our control.

  • Delivery Charges: Shipping fees are calculated during the checkout process and are based on your location and the size/weight of the products ordered.

  • International Shipping: For international orders, additional customs duties and taxes may apply, and you are responsible for any fees incurred.

7. Returns and Refunds

We want you to be satisfied with your purchase. If you're not happy with your order, you can return it under the following conditions:

  • Return Period: You can return products within 30 days of receiving your order.

  • Return Eligibility: Products must be unused, in original packaging, and in resalable condition to be eligible for return.

  • Non-returnable Items: Custom-made products are not eligible for return unless defective or made incorrectly, as per the Custom Orders section.

  • Refunds: Once the returned item is received and inspected, we will process your refund. Refunds will be credited to the original payment method.

  • Return Shipping: You are responsible for the cost of return shipping, unless the product is defective or there was an error with your order.

8. Product Warranty

We offer a warranty on many of our products, including custom-made products. The terms of the warranty, including the duration and coverage, vary by product. Please refer to the product's warranty documentation or contact us for specific warranty details.

9. Limitation of Liability

To the fullest extent permitted by law, Kaha Pilates will not be held liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or the products purchased from us.
